Our Website and services are intended for business owners and their authorized representatives. You must be at least 18 years of age and have the authority to bind the business you represent to enter into these Terms.

Services

We provide marketing and consulting services for gym and fitness studio owners, including lead generation, paid advertising management, AI-assisted lead nurturing and communication tools, review and SEO optimization, remarketing, and business coaching and consulting. Service offerings, scope, and pricing are described in the applicable service agreement, order form, or proposal provided at the time of engagement and are subject to change for future engagements at our discretion.

Consultations, Engagements, and Payments

Scheduling a Gameplan Session or consultation through our Website is free and does not create a service engagement. Paid services begin only upon mutual agreement as set out in the applicable service agreement. Unless otherwise stated in that agreement:

• Service fees may recur on a periodic basis (e.g., monthly) and continue until cancelled in accordance with the applicable agreement.
• Fees are payable in advance and are processed through our third-party payment providers.
• You are responsible for keeping your payment information current.

Cancellations and Refunds

Cancellation and refund terms are provided in the applicable service agreement at the time of engagement. Unless otherwise specified there, fees already paid are non-refundable. To cancel services, contact us at support@gym-members-now.com or by phone. We may require advance notice before the next billing cycle.

Results Disclaimer

Marketing and business results depend on many factors outside our control, including your market, pricing, staffing, sales process, and follow-through. Case studies, testimonials, and revenue figures presented on the Website reflect the experiences of specific clients and are not a promise or guarantee of your results. Where a specific performance guarantee applies to your engagement, its terms and conditions are set out exclusively in your service agreement, and that agreement governs.

Client Responsibilities

You agree to provide accurate business information, timely access to accounts and assets reasonably required to deliver the services (such as advertising accounts, phone numbers, and CRM access), and to respond to leads and communications generated by the services. You are responsible for compliance with laws applicable to your own business, including the handling of your customers' information.

Limitation of Liability

To the fullest extent permitted by law, GymMembersNow JMAR LLC, its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Website or services. Our total liability for any claim arising out of an engagement will not exceed the amounts paid by you for the services giving rise to the claim in the three (3) months preceding the event.

You agree to use the Website only for lawful purposes. You may not attempt to gain unauthorized access to any part of the Website, interfere with its operation, or use it to transmit harmful or unlawful content. Transactional and informational SMS messages may include appointment confirmations, schedule changes, reminders, and account alerts. Marketing and promotional SMS messages may include offers, promotions, events, and updates. Marketing SMS consent is not required as a condition of purchase. Message frequency varies. You can cancel the SMS service at any time by texting STOP to (859) 605-3405. After you send STOP, we will send a confirmation message and you will no longer receive SMS messages from us unless you opt in again.
